Access to this website, its information and all related actions or services associated with using this site, including purchase of goods, are subject to the following terms and conditions.

We reserve the right to amend these Terms and Conditions at any time, and your use of our website represents your agreement to be bound by any and all Terms and Conditions, including those amended. For this reason, we insist you read our Terms and Conditions each time you access this site. These terms are binding to all users of our site, and if you do not agree with all Terms and Conditions, then you may not access our site, nor have access to any information, tools, services or otherwise associated with Macoda and this site.

ONLINE SERVICES
Our services are provided to adults over the age of eighteen (18) years. By agreeing to our Terms and Conditions, you acknowledge that you are over 18 years old, or you are over the age of 18 years and have allowed any dependents below that age to use our site with your consent and agreement with those Terms and Conditions set out.

By accessing our site and therefore agreeing with our Terms and Conditions, you henceforth agree that you are not to use our products, services or information for any purpose other than that specified and set out by us. This includes, but is not limited to, actions or intentions which may be deemed as a violation of any and all laws in your jurisdiction.

ACCESS CONDITIONS
Macoda reserves the right to refuse your access to our site and its contents at any time for any reason at our discretion.

The use of any malware, virus, worm, data mining tool, extraction tool, mirror website, metatag, or anything similar which might impact our site, or any information, services or infrastructure related to the former, is strictly not allowed. Non-compliance to these Terms and Conditions henceforth terminates your Services. Macoda also reserves the right to issue you with a notice should we become aware of any of these practices taking place.

You are not permitted to copy any of the information available on this website, whether for purposes of display, distribution, reproduction, resale or exploitation, without former, written consent. This excludes parameters set out by the Copyright Act (1968). These Terms and Conditions give you limited access and use of our information, for personal use only.

All content and information made available on this site is either the property of Macoda, its parent or subsidiaries, or we are licensed to use that content. This includes applications, graphics, images, layouts and text. All Macoda trademarks, logos or brands, and those affiliated with Macoda, identified by “™” or “®” are either the property of Macoda, its parent or subsidiaries, or we are licensed to use them. Under these terms and conditions, your access to this website does not permit you to use those marks, or any of the aforementioned content in any commercial way, without prior written consent.

By agreeing to the Terms and Conditions, you understand that information provided by you may be changed as required to suite specific requirements set out by Macoda, and networks which are connected to it. As such, you understand that this information may be transferred unencrypted.

ACCURACY AND CURRENCY
This website is intended as a reference for information pertaining to Macoda and its operations. The information available on this site may not be accurate or current. Therefore, it should not be relied on as a complete or distinctive source of information. Macoda is not liable for any subsequent misconceptions you might have, and relying on this site singularly is done so at your own risk. Macoda reserves the right to, at any time and without prior notice, modify or discontinue our products, services, information and prices. Henceforth, Macoda will not be liable for any of the aforementioned changes; to you or any third party. If you have placed an order, we will fulfill your order at the price listed at the time of your order or offer a full refund if we are unable to fulfill the order.

Our intention is to list items as accurately as possible for you, however, we cannot guarantee that images and information displayed on this site will perfectly match any product or service received. Moreover, we cannot assure you that the quality, look, specifications or general merchantability regarding our products or services will meet your own preconceived expectations. As such, we are not liable for any expectations which are not met.

We operate with limited quantities, which are subject to change or misrepresentation online through error, including product shipping times, prices and availability. By accepting there Terms and Conditions, you accept that we can discontinue our products or services at any time, or limit our provision of products or services at our own discretion, and to any degree or in any context. This includes, but is not limited to, orders that we believe may be conducted by entities intent on redistributing or reselling our product(s).

In the event that we do not accept an order, by way of changing it or canceling it, we will attempt to contact you through information you have provided, but are not liable if we are unable to do so. If the information you have provided is false or non-current, Macoda cannot be expected to complete any order or transaction. These parameters are also relevant to our Returns Policy.

Macoda reserves the right to, by our own discretion, remove or edit submitted content we perceive as unlawful, defamatory, obscene, unfair, and unpleasant or a violation of these Terms and Conditions.

Consequently, when you agree to provide information to us for the purpose of submission or completing a transaction, you agree that all contact and billing information, including credit card information, is current, accurate and belonging to your or provided by you with the holders consent. You also agree that you are not using a false means of communication, or misleading us in any manner. This includes using this site as a means to obtain the private information of parties involved with Macoda, including its beneficiaries, website users, clients and related entities. As such, you are henceforth responsible for any and all submissions and information provided. In turn, Macoda is not responsible for any comments or submissions you provide, or those provided by another party which may be accessible via this site.

AGREEMENT
Any perceived ambiguities in these Terms and Conditions shall not be framed contra proferentem. The Terms and Conditions provided to you act conjointly with any other guidelines, rules or policies presented by us and made available to you in constituting the understanding and agreement between both parties. Your agreement with the greater Terms and Conditions dictates your use of our service in all contexts. Any prior or concurrent agreements between you and Macoda are supplanted by the aforementioned entire agreement. Non-action on our behalf pertaining to a breach of any component in these Terms and Conditions does not render that part of the Terms and Conditions void, nor does it annul the Terms and Conditions or agreement(s) in their entirety.

LIABILITY
Under no circumstances shall Macoda, its beneficiaries, parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees be liable for any consequential damages related to your use of our service, or any product acquired through our service. This includes, but is not limited to: injury, loss, lost revenue, replacement costs and lost data. Macoda does not guarantee that our service will be error free or completely secure. Henceforth, you agree that your use of these services is done so at your own risk. Products purchased through this site are provided as available and as is. Furthermore, any implied merchantability is bound by no warranty or conditions.

INDEMNIFICATION
Following any claim or demand, including attorney’s fees, made by a third party as a result of your breach of our Terms and Conditions, the information they reference, or the violation of any law or the rights of a third party, you agree to indemnify, defend and hold harmless Macoda, its beneficiaries, parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licencors, service providers, subcontractors, suppliers, interns and employees.

TERMINATION
Under our own discretion, if believe you have failed to comply with our Terms and Conditions, we reserve the right to terminate any agreement between both parties and deny access to our services. This can be done without notice, and under these conditions, you will be held liable for all outstanding amounts due, up to and including the day of termination. Similarly, you may terminate the agreement at any time by way of notifying Macoda that you no longer wish to use our services, or by ceasing use and observation of this site. Any liabilities incurred prior to termination by either party, shall survive termination of this agreement. All Terms and Conditions are considered effective unless terminated by either party.

SALVATORIOUS
Should any constituent of our Terms and Conditions be deemed as annullable, unlawful, and ineffectual or having the grounds for repeal, those relevant constituents shall be subject to any applicable law. Moreover, those components of the Terms and Conditions shall be considered severed from the Terms and Conditions, which will otherwise be unaffected and all remaining parts deemed as legitimate, inherent and statutory.

MATTRESS

If you aren't completely satisfied with your Macoda mattress within the 100 night trial period we offer a free return and full refund.

All you'll need to do is contact us and we'll provide you with a return form. We'll organise for your mattress to be collected, then provide a full refund once the collection has occurred. We only ask that you give the Macoda Mattress 28 nights before making a decision as it can take time for your body to a adjust to a new mattress.

In certain areas where a free collection is not possible, return of the mattress to a suitable facility becomes the responsibility of the customer, and a refund will not be processed until receival by a third party is confirmed. Suitable facilities include registered charitable organisations or recycling facilities that will take receipt of the mattress. If you require a return within 14 days of receiving the mattress, there is an early collection fee of $100, which will be deducted from your refund. Mattresses that are stained or damaged will not be eligible for a refund. Your return form must be completed within the 100 night trial period for the return to be accepted. If, after reasonable attempts to contact you and/or confirm a booking with you for collection are made without a response and after reasonable time has passed, your return will be closed.

The 100 Night Trial is only applicable for your first order, and is limited to one mattress return per household. Your mattress won't be eligible if you order the wrong size or wish to change sizes for whatever reason. In this case, if the mattress is unopened and in it's original packaging, it may be exchanged for another size while incurring a re-stocking fee.

Returned mattresses are either donated to local charities or their materials are recycled.

PILLOWS

If you aren't completely satisfied with your Macoda Pillow within the 60 night trial period we offer a free return and full refund.

We only ask that you give the Macoda Pillow 14 nights before making a decision, as your body can take time to adjust to a new pillow.

In the event of a return, simply contact us. We'll send you a pre-paid return label, and all you need to do is attach it to the box and send it back to us. For non-metro areas, you may be required to cover the cost of postage. If the pillow is damaged, infested or stained it will not be eligible for a return or refund.

This policy is limited to a maximum of two pillows to be returned per household, and is only applicable to a customer's first order.

If your Macoda Pillow was a free item in conjunction with a promotion it will not be eligible for a return / refund. If you purchase a Macoda Mattress and receive a Macoda Pillow as a promotional gift and wish to return the mattress, you have the option to keep the pillow(s) and have the cost deducted from the refund (at a discounted rate) OR return the pillow(s) and simply cover the return postage cost.

BEDDING

If you aren't completely satisfied with your Macoda Sheet Set, Duvet Set or Mattress Protector within the 60 night trial period, we'll give you a full refund.

We only ask that you give your products 14 nights before making a decision.

In the event of a return, simply contact us. We'll process a return and ask you to fill out a short feedback survey. Then just send it back to us. If your sheets are damaged, infested or stained it will not be eligible for a return or refund.

For Sheets, this policy is limited to a maximum of 1x Sheet Set & 1x Duvet Set to be returned per household, and is only applicable to a customer's first order.

For the Mattress Protector, the policy is limited to 1x Mattress Protector to be returned per household, and is only applicable to the customer's first order.

If your Macoda Sheet Set/Duvet Set or Mattress Protector was a free item in conjunction with a promotion, they will not be eligible for a return / refund. If you purchase a Macoda Mattress and receive these products as a promotional gift and wish to return the mattress, you have the option to keep the gift and have the cost deducted from the refund (at a discounted rate) OR return the product(s) and simply cover the return postage cost.

MATTRESS

Macoda offers warranty on all its mattresses for a period of 10 years. This warranty covers defects in workmanship or materials. A warranty claim can only be made by the original purchaser and owner and if the product was purchased directly from Macoda. Macoda will assess major defects in the mattress which do not constitute general limitations of prolonged use.

WHAT WE COVER

Any indentation in the mattress greater than 35mm that is present when no weight is applied to the mattress.
Workmanship faults where materials may be broken or defective.

WHAT’S NOT COVERED

Personal preference in mattress feel, which may be subject to change over time.
Any damage due to abnormal use or moving of the Macoda mattress, including the use of an inappropriate bed base (refer to FAQ).
Normal changes or wear in the mattress, such as small indentations due to the memory foam conforming to your body.
Soiled, stained or unsanitary mattresses
Mattress odour present in the materials
Any minor manufacturing flaws

HOW IT WORKS

If you believe your mattress should be assessed for warranty claim please contact us. We will require photographs and a description of the defect in order to make any assessment as we are an online provider.

WHAT WE DO

Based on the information you provide, we will determine whether the mattress needs to be assessed. Hereafter, we will determine where the defect originated from and what caused it, and act accordingly.

Macoda will repair or replace any components that adhere to our warranty guidelines. We also reserve the right to offer a refund or a replacement of equal value should your item have been discontinued.

We cannot guarantee that any repair or replacement will be in perfect new condition. A replacement or repair does not extend the original warranty period, or initiate a new warranty period.

PILLOWS

Macoda offers warranty on all its pillows for a period of 3 years. This warranty covers defects in workmanship or materials. A warranty claim can only be made by the original purchaser and owner and if the product was purchased directly from Macoda. Macoda will assess major defects in the pillow which do not constitute general limitations of prolonged use.

Macoda will assess major defects which do not constitute general limitations of prolonged use.
